Terms of Use

By accessing or using FirePrep360 ("we," "us," or "our") and its services, including training tools, simulations, coaching features, and related content (the "Services"), you agree to be bound by these Terms of Use ("Terms").

If you do not agree to these Terms, you may not use the platform.

We may update these Terms from time to time. Continued use of the Services after updates become effective constitutes acceptance of the revised Terms.

Your use of the Services is also governed by our Privacy Policy. By using the platform, you consent to the collection and use of your information as described there.

To use the platform, you must meet the following requirements and responsibilities:

• You must be at least 18 years old to use the Services.
• You agree to provide accurate and complete account information, including your name, email, department affiliation if applicable, and training goals.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• We are not liable for unauthorized use resulting from your failure to secure your account.
• We reserve the right to suspend or terminate accounts at our discretion, including for violations of these Terms.

The platform may include the following Services:

• Fireground simulation training.
• Interview and promotional preparation.
• Written test practice.
• AI-generated scenarios and feedback.
• Coaching marketplace services.
• We do not guarantee promotion results, hiring outcomes, or exam success.

If you purchase paid Services, the following terms apply:

• Paid services are processed through Stripe.
• By purchasing a subscription, you agree to pay all applicable fees and any recurring charges associated with your selected plan.
• Unless otherwise stated, all payments are non-refundable.
• We may modify pricing or features in the future, but changes will not retroactively affect an active billing period already paid for.

When using coaching features, the following terms apply:

• Coaches available through the platform are independent providers and are not employees of FirePrep360.
• You are responsible for selecting coaches, evaluating qualifications, and participating in coaching sessions.
• We are not liable for coaching outcomes, recommendations, or advice provided by coaches.

You agree not to misuse the platform. Prohibited conduct includes:

• Using the platform for unlawful purposes.
• Attempting to hack, disrupt, probe, scrape, or reverse engineer the system except as permitted by law.
• Sharing, reselling, copying, or redistributing platform content without authorization.
• Misrepresenting your identity, credentials, or affiliation.

Ownership and content-use terms are as follows:

• All platform content, including simulations, questions, training materials, software, visuals, and branding, is owned by FirePrep360 or its licensors and is protected by applicable intellectual property laws.
• You may not copy, reproduce, distribute, modify, or use platform materials for commercial purposes without prior written permission.
• If you submit responses, notes, uploads, or other materials, you retain ownership of your content, but you grant us a non-exclusive license to host, use, process, and analyze that content as needed to operate and improve the platform and Services.

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

We do not guarantee the accuracy of simulations or AI-generated content, uninterrupted availability, or error-free performance.

To the maximum extent permitted by law, FirePrep360 will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of income, promotion opportunities, or career outcomes.

Our total liability for any claim arising out of or relating to the Services is limited to the amount you paid to us during the 90 days preceding the event giving rise to the claim.

You acknowledge that platform simulations and training content are educational tools only. They do not replace real-world training, department SOPs, medical direction, incident command authority, legal requirements, or professional judgment.

You remain solely responsible for decisions and actions taken in real-world settings.

We may terminate or suspend access to the Services at any time, including for:

• Violations of these Terms.
• Abuse, misuse, or disruption of the platform.
• Operational, legal, or security reasons.
• Upon termination, your access may be revoked immediately and, unless otherwise required by law, no refunds will be issued.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

To the extent permitted by law, disputes arising from or relating to these Terms or the Services will be resolved through binding arbitration rather than in court.

You waive any right to a jury trial or to participate in a class action, except where such waivers are prohibited by law.

We may revise these Terms at any time. We will update the effective date and last updated date on this page when changes are made. Continued use of the platform after revised Terms become effective means you accept them.

Additional legal terms include the following:

• If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
• These Terms constitute the entire agreement between you and FirePrep360 regarding the Services and supersede prior or contemporaneous understandings on that subject.
